Child Custody and Visitation

If the spouses cannot agree on child custody, the courts are required to make determinations that are in the best interests of the children. The courts may decide to award joint custody, or grant one parent primary custody and visitation to the other. Our experienced attorneys will work closely with you to reach an outcome that is mindful of your children’s best interests.

Child Support

While each parent has the responsibility for the financial well being of their children, the courts ultimately make decisions about child support based on an income share method found in the Tennessee Child Support Guidelines. The objective is to reach an arrangement that is fair and equitable based on a number of factors, including:

  • The gross income of each parent
  • The number of days the child spends with each parent
  • Whether one parent is receiving alimony or spousal support
  • The educational, health and medical expenses of the children

Divorce Mediation

While divorce proceedings often become contentious, there is an alternative way to resolve these disputes: mediation. This approach is designed to be more civil and cost effective and reduce the emotional and financial burden for each party. In a divorce mediation, the spouses hire a neutral mediator who works with their attorneys to reach an agreement that is fair. Ultimately, this process requires the cooperation of both parties and for each to engage in a good faith negotiation.

Adoption is a legal process in which a new relationship is created between the adoptive parent and the child. Adoptive parents are granted the same rights and responsibilities as parents of a natural child while the adopted child also has the same legal rights as a biological child. While adopting a child can be a very rewarding experience, the process is complicated and involves a number of legal and bureaucratic hurdles. With our working knowledge of the adoption laws in Tennessee, we will help you understand your rights and responsibilities as an adoptive parent and guide you through the entire process.

When a child is born to parents who were not married, questions of the biological father’s identity may be raised. At times, a mother may need to establish paternity in order to be awarded child support. Similarly, a father may seek to establish paternity in order to be granted visitation rights. Regardless of the circumstances, we help clients pursue or defend paternity actions in the Tennessee juvenile courts.

Same-Sex Couples

In 2015, the U.S. Supreme Court ushered in marriage equality by recognizing the right of same-sex couples to marry. Now, these couples also have the legal right to divorce. As this area of law evolves, these cases require the proper legal counsel that our attorneys are uniquely qualified to provide. We are dedicated to representing non-traditional families in aspects of family law.
